Do all cases go to a Final Hearing?
No – it is possible to settle cases at any stage during the court process.
Even when court proceedings are running, it is still possible to use mediation as a way forward – to sort out one or all of the issues. Mediation can focus on financial issues or on issues about the children.
It is quite common during financial proceedings still to be able to use mediation to talk about the children’s issues. Having a separate Dispute Resolution method can keep these separate and apart.
Can I issue divorce proceedings in more than one country?
Yes – it is often possible to issue divorce proceedings in more than one jurisdiction. For example, a French couple living in London can potentially issue proceedings for divorce both in England and Wales and in France. The outcome will be radically different, particularly regarding finances. The same court deals with the finances as deals with the divorce in most cases.
Timing is critical too. Particularly in the EU, issuing proceedings first can be decisive. It is of critical importance to consult a lawyer as soon as possible. Members of this group are experts in these issues, and have a worldwide expert to consult as well.
Is this the most expensive process?
Usually it is, because the process is less easy to control and because of the delays which inevitably arise when using the courts. The legal procedures in the court process have to adopt a “one size fits all” approach, so the paperwork is substantial, and often less focused.
